Obama's health care aid to small firms disappoints

(AP) ? It seemed like a good idea at the time.

But a health insurance tax credit for small businesses, part of President Barack Obama's health care law that gets strong support in public opinion polls, has turned out to be a disappointment.

Time-consuming to apply for and lacking enough financial reward to make it attractive, the credit was claimed by only 170,300 businesses out of a pool of as many as 4 potentially eligible million companies in 2010.

That's put the Obama administration in the awkward position of asking Congress to help fix the problems by allowing more businesses to qualify and making it simpler to apply.

But Republicans who run the House say they want to repeal what they call "Obamacare," not change it.

"They completely missed the target on this thing," Rep. Sam Graves, R-Mo., said of the tax credit. "I don't think expanding it is going to make any difference whatsoever." Graves chairs the House Small Business Committee.

It doesn't help the administration's plea that the biggest small-business lobbying group is a lead plaintiff asking the Supreme Court to overturn the Affordable Care Act. The National Federation of Independent Business isn't likely to spend much time tinkering with the tax credit or promoting it to members.

Small businesses represent the crumbling edge of the nation's system of employer-based health care. Only about 30 percent of companies with fewer than 10 workers offer health coverage, and they often pay more for insurance than large businesses. The credit, which once had support in principle from lawmakers of both parties, was supposed to help businesses already providing coverage afford the premiums. And maybe it would even entice some to start.

"We agree it is not a panacea for all costs," said John Arensmeyer, founder of Small Business Majority, an advocacy group that supports the health care law and disagrees with the much larger independent business federation. The problem is all the negative publicity around the health care law has discouraged business owners from applying for the credit, he says.

"There has been more heat than light shone on this," Arensmeyer said. "There is no reason why small businesses shouldn't be taking advantage of this credit." About 770,000 workers were covered by the businesses claiming the credit in 2010.

However, a recent report by Congress' nonpartisan Government Accountability Office identified several issues with the credit itself.

To begin with, the GAO said, the tax credit is structured so its biggest benefits go to very small companies paying low wages. About 4 out of 5 such businesses don't offer coverage, and the tax credit is not sufficient to encourage them to start doing so.

"Small employers do not likely view the credit as a big enough incentive to begin offering health insurance," the report said.

The average credit claimed in 2010 was about $2,700, although some companies qualified for much more.

Many small firms did not qualify because they paid fairly decent wages. The GAO report quoted an unidentified tax preparer who explained that "people get excited that they're eligible and then they do the calculations and it's like the bottom just falls out of it and it's not really there." It's almost a bait and switch.

Complexity has been another obstacle. IRS Form 8941, which employers must complete to claim the credit, has 25 lines and seven worksheets, the GAO said. Some tax preparers told the agency it took clients from two to eight hours to pull together supporting information and tax professionals another three to five hours to calculate the credit.

Trying to help, the IRS identified "three simple steps" employers needed to follow, but the GAO found "the three steps become 15 calculations, 11 of which are based on seven worksheets, some of which request multiple columns of information."

Arensmeyer said claiming the credit will be simpler once it becomes standard in tax-preparation software.

As it stands now, the credit is only temporary, expiring in 2016. That's another reason Congress appears unlikely to adopt the administration's proposed fixes, which would cost an estimated $14 billion that has to be offset with cuts elsewhere.

If the health care law withstands Supreme Court scrutiny, more employers could start claiming the credit. Otherwise, it may just go down as a missed opportunity, for policymakers and small-business owners alike.

Lynn, Cards extend Braves' skid to 8

ATLANTA (AP) - Lance Lynn joined Philadelphia's Cole Hamels as the major leagues' first eight-game winners, and the St. Louis Cardinals' extended the Atlanta Braves' longest losing streak in two years to eight games with an 8-2 victory Monday.

Lynn (8-1) allowed two runs and five hits in seven innings. While he was dominating the Braves, Hamels pitched the Phillies to an 8-4 win at the Mets.

Atlanta is on its worst skid since the Braves lost nine in a row from April 21-29, 2010. The Braves have given up seven runs or more in four straight games.

Daniel Descalso hit a two-run homer as a fill-in starter at third base for David Freese, who was given a day off with a mild sprain of his right hand.

Rafael Furcal had three hits, including a homer, and Matt Adams had three hits with three RBIs for St. Louis.

Marc Rzepczynski and Eduardo Sanchez followed Lynn with hitless relief, completing a five-hitter.

Atlanta's Tommy Hanson (5-4) gave up six runs and eight hits in 3 1-3 innings. He left the bases loaded in the first and stranded a runner on third base in the second, then fell behind 4-0 in the third.

Matt Holliday singled and scored on Brian McCann's passed ball. After Carlos Beltran was caught in a rundown between third and home when he broke for the plate on a pitch, Yadier Molina singled in a run and Descalso followed with his second home run this season.

Furcal's home run off hanson and Adams' RBI single off Kris Medlen made it 6-0 in the fourth.

Juan Francisco had a two-run single in the bottom half. Adams added a two-run double against Medlen in the sixth.

Braves first baseman Freddie Freeman didn't start for the third straight day due to vision problems.

Freeman said he can't wear contacts because his tear ducts aren't producing. He can't wear normal glasses when playing because he can't see when hitting from his closed stance. He said he hopes prescription sports goggles will arrive Tuesday.

Atlanta arranged a Memorial Day surprise for the family of Air Force Sgt. David Sims in the middle of the fifth inning.

Sims' wife, Robin, and four children were on the field to see his message to the family shown on the Braves video board. Sims, who has been serving in Afghanistan, emerged on the field after the video and was quickly engulfed by a group hug from his children, followed by a long embrace from his wife, as the crowd of 42,426 cheered.

Here is what actually went down according to witnesses who spoke to TMZ: The photographer was blocking Bieber's car; the singer asked him to move; and a scuffle did ensue when the "journalist" refused to do so.

But an attorney then approached the photographer and explained how he could get a lot of money if he called and ambulance and pressed charges.

No word yet from anyone in Justin's camp, while authorities are hoping to speak to Bieber and Gomez some time this week.

Chris Hayes, MSNBC Commentator, Questions "Hero" Designation for Military Members


Chris Hayes, a political commentator on MSNBC, has created quite a stir - on Memorial Day of all days - for remarks he made yesterday in regard to the designation of military personnel as "heroes."

The journalist said he feels "uncomfortable" throwing that word about because it is "so rhetorically proximate to justifications for more war." In other words: How can we refer to someone as heroic if we disagree with the cause for which he or she died?

It certainly seems like an odd way to make a point about war. Surely we can differentiate between policy and the troops carrying out that policy in the name of a country they love, can't we? Watch the clip and form your own opinion.

Scientist: Evolution debate will soon be history

NEW YORK (AP) ? Richard Leakey predicts skepticism over evolution will soon be history.

Not that the avowed atheist has any doubts himself.

Sometime in the next 15 to 30 years, the Kenyan-born paleoanthropologist expects scientific discoveries will have accelerated to the point that "even the skeptics can accept it."

"If you get to the stage where you can persuade people on the evidence, that it's solid, that we are all African, that color is superficial, that stages of development of culture are all interactive," Leakey says, "then I think we have a chance of a world that will respond better to global challenges."

Leakey, a professor at Stony Brook University on Long Island, recently spent several weeks in New York promoting the Turkana Basin Institute in Kenya. The institute, where Leakey spends most of his time, welcomes researchers and scientists from around the world dedicated to unearthing the origins of mankind in an area rich with fossils.

His friend, Paul Simon, performed at a May 2 fundraiser for the institute in Manhattan that collected more than $2 million. A National Geographic documentary on his work at Turkana aired this month on public television.

Now 67, Leakey is the son of the late Louis and Mary Leakey and conducts research with his wife, Meave, and daughter, Louise. The family claims to have unearthed "much of the existing fossil evidence for human evolution."

On the eve of his return to Africa earlier this week, Leakey spoke to The Associated Press in New York City about the past and the future.

"If you look back, the thing that strikes you, if you've got any sensitivity, is that extinction is the most common phenomena," Leakey says. "Extinction is always driven by environmental change. Environmental change is always driven by climate change. Man accelerated, if not created, planet change phenomena; I think we have to recognize that the future is by no means a very rosy one."

Any hope for mankind's future, he insists, rests on accepting existing scientific evidence of its past.

"If we're spreading out across the world from centers like Europe and America that evolution is nonsense and science is nonsense, how do you combat new pathogens, how do you combat new strains of disease that are evolving in the environment?" he asked.

"If you don't like the word evolution, I don't care what you call it, but life has changed. You can lay out all the fossils that have been collected and establish lineages that even a fool could work up. So the question is why, how does this happen? It's not covered by Genesis. There's no explanation for this change going back 500 million years in any book I've read from the lips of any God."

Leakey insists he has no animosity toward religion.

"If you tell me, well, people really need a faith ... I understand that," he said.

"I see no reason why you shouldn't go through your life thinking if you're a good citizen, you'll get a better future in the afterlife ...."

Leakey began his work searching for fossils in the mid-1960s. His team unearthed a nearly complete 1.6-million-year-old skeleton in 1984 that became known as "Turkana Boy," the first known early human with long legs, short arms and a tall stature.

In the late 1980s, Leakey began a career in government service in Kenya, heading the Kenya Wildlife Service. He led the quest to protect elephants from poachers who were killing the animals at an alarming rate in order to harvest their valuable ivory tusks. He gathered 12 tons of confiscated ivory in Nairobi National Park and set it afire in a 1989 demonstration that attracted worldwide headlines.

In 1993, Leakey crashed a small propeller-driven plane; his lower legs were later amputated and he now gets around on artificial limbs. There were suspicions the plane had been sabotaged by his political enemies, but it was never proven.

About a decade ago, he visited Stony Brook University on eastern Long Island, a part of the State University of New York, as a guest lecturer. Then-President Shirley Strum Kenny began lobbying Leakey to join the faculty. It was a process that took about two years; he relented after returning to the campus to accept an honorary degree.

Kenny convinced him that he could remain in Kenya most of the time, where Stony Brook anthropology students could visit and learn about his work. And the college founded in 1957 would benefit from the gravitas of such a noted professor on its faculty.

"It was much easier to work with a new university that didn't have a 200-year-old image where it was so set in its ways like some of the Ivy League schools that you couldn't really change what they did and what they thought," he said.

Earlier this month, Paul Simon performed at a benefit dinner for the Turkana Basin Institute. IMAX CEO Rich Gelfond and his wife, Peggy Bonapace Gelfond, and billionaire hedge fund investor Jim Simons and his wife, Marilyn, were among those attending the exclusive show in Manhattan's Chelsea neighborhood.

Simon agreed to allow his music to be performed on the National Geographic documentary airing on PBS and donated an autographed guitar at the fundraiser that sold for nearly $20,000.

Leakey, who clearly cherishes investigating the past, is less optimistic about the future.

"We may be on the cusp of some very real disasters that have nothing to do with whether the elephant survives, or a cheetah survives, but if we survive."

Sony In-Game Advertising Patent Surfaces - Explosion.com

Apparently, Sony?s plan for the next generation of gaming isn?t the Playstation 4, more realistic graphics, or even virtual reality ? it?s an integrated pop-up ad delivery service. While we users of the internet have been waging a constant war against pop-up ads since the start of the World Wide Web, Sony Computer Entertainment America is filing patents that aim only to set us back from any advancements we have made in the perilous fight.

Spotted by a member of the NeoGAF forums was a patent filed by Sony in July of 2011 for a concept that would allow for pop-up advertisements to interrupt gameplay. The mechanics of this concept have it so that gameplay would slow down briefly before pausing completely for the advertisement to play. Anybody that went through their youth as a gamer youth knows the unnerving frustrations of having to pause every time mom thought the garbage smelled bad enough to need to be removed from the house. If implemented, hopefully these advertisements will have the sense that mother did not and will avoid interrupting hour long boss fights right when you get used to the flow of the battle.

According to the specifics filed with the patent, anyone that feels they would be immune from the random stoppage by playing on-line multiplayer would be horribly wrong. The year old patent hints that the program would be set up to interrupt all network-based games, gradually slowing down and pausing each individual?s screen simultaneously. On the bright side, once gameplay continues, all involved parties of the match will have something else to bicker about besides ?your mother? and the size of their genitals.

Though it may seem like nothing but horrible backlash would come from the implementation of this patent, there could actually be a few benefits that stem from it. For one, with revenue coming in from advertising, Sony could continue offering a free on-line service when the next generation of systems finally launch. With an added source of income, there is also the slight possibility that Sony could offer lower prices on its downloadable content, putting it a step ahead of the competition.

Of course, this is all beyond speculation. Since the July 22nd, 2011 filing of the patent, Sony has been tight lipped about the concept, having spent the bulk of its time dispelling rumors of a PS4 and amping up marketing for the PS Vita. Is it a concept they actually plan on implementing; or are they just covering all basis, ensuring that if anyone were to jump onto the in-game advertising bandwagon they would receive a cut for owning the rights to the concept?

With E3 2012 right around the corner, this discovery will probably have gamers at the edge of their seats during Sony?s press conference at the trade show. Chances are, though, if the company has yet to let anything slip about the patent in the year after filing it, there will be little to no mention of it amongst the excitement of God of War IV: Ascension and PS Vita?s All-Stasr Battle Royal.

Saeima Upholds in 1st Reading Proposals for Tax Reduction ...

Saeima upheld in the first reading the legislative amendments providing for reduction of the standard value-added tax (VAT) rate to 21% from July 1 this year and gradual lowering of personal income tax from January 1, 2013, till 2015. The 100-member Latvian parliament upheld the bill about lowering personal income tax with 94 votes for and the bill about VAT reduction with 93 votes for.

The lawmakers also supported the proposal to treat the bill as urgent, which means that there will be only two readings in the parliament instead of three under the regular procedure.

The standard VAT rate in Latvia at the moment is 22% as opposed to 21% in Lithuania and 20% in Estonia. The purpose of the bill is to reduce the VAT rate in Latvia to bring it closer to the tax rates charged in the neighbouring countries in order to boost Latvia?s regional competitiveness and offset the inflationary pressure created by global price hikes. Also, reducing the tax burden might reduce the impact of inflation, encourage consumption and have positive effects on business growth, the Finance Ministry said.

Personal income tax is to be lowered from current 25% to 24% in 2013, to 22% in 2014 and to 20% in 2015.

The Finance Ministry said that the purpose of the labour tax reforms was to ensure for Latvia labour taxes that cost-wise would put in on equal footing with the neighbouring Baltic States in the competition for investments and jobs. ?By reducing the overall labour tax burden, we will also reduce the risks of poverty and structural unemployment, the shadow economy and the motives for tax evasion,? the ministry said.

Everest will be crowded again days after 4 killed

KATMANDU, Nepal (AP) ? Days after four people died amid a traffic jam of climbers scrambling to conquer Mount Everest, Nepal officials said a similar rush up the world's tallest peak will begin soon, and there's little they can do to control it.

About 200 climbers are expected to attempt to scale the 8,850-meter (29,035-foot) mountain between Friday and Sunday, Nepali mountaineering official Gyanendra Shrestha said. Some have been at a staging camp for days, waiting for a window of good weather during this worse-than-usual climbing season.

A similar crowd of 208 climbers headed to the summit last week, and four died Saturday in one of the deadliest days ever on the mountain.

Ha Wenyi of China, Eberhard Schaaf of Germany, Nepal-born Canadian Shriya Shah and South Korean Song Won-bin died on their descents from the summit, apparently from exhaustion and altitude sickness.

Shrestha also said a Nepalese Sherpa guide who had been reported missing reached the base camp safely on Monday. The guide was separated from his group and did not have communications equipment, Shrestha said Tuesday.

The deaths have raised concerns about overcrowding above the highest camp on the mountain. The area is nicknamed the "death zone" because of the steep icy slope, treacherous conditions and low oxygen level.

Describing a "traffic jam" of climbers Saturday, Shrestha said climbers were heading to the summit at 2:30 p.m., even though 11 a.m. is the latest start time recommended. That meant climbers were staying too long at high altitudes and exhausting their oxygen supplies because they didn't anticipate having to wait.

Now, with a similarly large number of climbers expected to head up the same trail under similar conditions, Nepalese authorities acknowledged safety concerns but said they can't turn any of them away.

"The climbers have received the permits to climb within specific dates. We cannot say who gets to get to the summit on which dates because of the unpredictable weather. When weather clears up they all want to benefit," said Nepal's Tourism Ministry spokesman, Bal Krishna Ghimire.

Apa, a Nepalese Sherpa guide who has scaled Everest a record 21 times, said climbers are eager to take advantage of good conditions because "the window of good weather is so short," and they are afraid they may not get another chance to climb to the summit.

He said the traffic jam of climbers going up and down the same icy trail makes it hazardous, especially with climbers already exhausted from having climbed all night from the last camp, at 8,000 meters (26,246 feet).

"And having to wait for extra hours and the delays only makes the situation worse," said Apa, who uses only one name.

Ghimire said it is up to the climbers and their teams to assess the conditions and safety.

"We have officials at the base camp, but beyond that it is mostly up to the climbers," Ghimire said.

He said that eventually, the government plans to set up a seasonal office at the base camp equipped with doctors, weather experts and security personnel. Ghimire said they also have plans to give each climber a tracking device.

More than 3,000 people have climbed Everest since Edmund Hillary and Tenzing Norgay became the first to do so in 1953. Some 225 climbers have died attempting it.

The deadliest day was May 10, 1996, when eight people were killed. The main reason was said to be that climbers who started their ascent late in the day were caught in a snowstorm in the afternoon and lost their way.

The climbing season normally runs from late March to the first week in June, but this year the season's first clear conditions were on Friday and Saturday. A windstorm hit the higher altitudes by Saturday afternoon.

The service allows DISH to take a bunch of content that doesn't usually have a huge audience, and doesn't cost a whole helluva lot to license, and make it available to niche audiences.
