Mayor: Colorado Springs fire destroys 346 homes

COLORADO SPRINGS, Colo. (AP) -- After waiting for two days, Rebekah and Byron Largent learned from lists distributed by authorities that their home was among the hundreds that burned to the ground in the most destructive wildfire ever to rage across Colorado.

It was especially hurtful as their house was destroyed on their daughter Emma's first birthday.

"Our minds just started sifting through all the memories of that house that we lost that can't be replaced," Rebekah Largent said Thursday night. She remembered her wedding dress, a grandmother's china, the rocking chair where the couple would sit with Emma.

"Our little girl, our 1-year-old daughter, that's the house that she's lived in the longest. It's just really hard to have lost a lot of the memories connected to that, you know? They just burned," she said.

Officials said the Waldo Canyon fire that forced tens of thousands to flee this city 60 miles south of Denver destroyed an estimated 346 homes and left at least one person dead.

Police Chief Pete Carey said the remains of one person were found in a home where two people had been reported missing. He didn't elaborate or take questions after making the announcement late Thursday.

President Barack Obama was to tour fire-stricken areas Friday after issuing a disaster declaration for Colorado, releasing federal funds to help,

A fire in northern Colorado, which is still burning, destroyed 257 homes earlier this month and until Thursday was the state's most destructive.

From above Colorado Springs, the destruction was painfully clear: Rows and rows of houses were reduced to smoldering ashes even as some homes just feet away survived largely intact.

When he first saw the aerial photos of the homes burned in his neighborhood, Ryan Schneider recognized immediately that his house had been spared.

But relief quickly turned to sadness for his many friends and neighbors who hadn't been so lucky.

"I mean, there's a lifetime of things that people collect in these homes, and they've lost it all," said Schneider, vice president of the 1,700-home community association for the Mountain Shadows neighborhood.

Amid the devastation in the foothills of Colorado Springs, there were hopeful signs. Weather conditions improved Thursday and some evacuation orders were lifted by the evening, though there was no immediate word on how many people would be allowed back. People were told to still be ready to flee at a moment's notice.

The Air Force Academy was letting residents return Friday morning and officials said normal operations would resume throughout most of the academy.

"We're gaining more confidence," said Bret Waters, director of the Colorado Springs emergency management office. "It doesn't mean we're out of the woods."

More than 30,000 people frantically packed up belongings Tuesday night as the flames swept through their neighborhoods.

The Colorado Bureau of Investigation said two people have been arrested in connection with a burglary at an evacuated home.

Community officials began the process of notifying residents Thursday that their homes were destroyed. The lists of more than 30 street names were posted at a local high school, listing those areas with heavy damage. Anxious residents scanned the sheets, but for many, the official notification was a formality. They recognized their street on aerial pictures and carefully scrutinize the images to determine the damage. Photos and video from The Associated Press and the Denver Post showed widespread damage.

Colorado Springs, the state's second-largest city, is home to the U.S. Olympic Training Center, NORAD and the Air Force Space Command, which operates military satellites. They were not threatened.

Conditions were still too dicey to allow authorities to begin trying to figure out what sparked the blaze that has raged for much of the week and already burned more than 29 square miles.

More than 1,000 personnel and six helicopters were fighting the fire, which had cost at least $3.2 million to fight and was 15 percent contained as of Thursday.

Hundreds of people sought refuge at area shelters operated by the Red Cross, including tourists who'd come to enjoy the Colorado summer.

Preston Harrington, 40, of Lake Charles, La., had been hoping to climb nearby Pikes Peak.

He had been at a Manitou Springs motel when he was evacuated early Sunday, and then moved to a shelter at a high school and was living out of a suitcase

"No drawer, nothing to put this stuff in, it wears on you," Harrington said.

Schneider, the local neighborhood leader, said the enormity of the losses would take a while to sink in.

"There's a lot of tears being shed out there, it's tough," he said.

Among the fires elsewhere in the West:

- A 72-square-mile wildfire in central Utah has destroyed at least 56 structures and continues to burn with just 20 percent containment, authorities said. Officials expected the damage estimate to rise as they continue their assessment.

- The smaller fire near St. George started Wednesday and had grown to 2,000 acres by midnight, forcing some residents to evacuate. The fire was burning about three miles north of Zion National Park. At least eight structures were destroyed.

- Fire crews in southeastern Montana used a break in the weather to dig containment lines around two wildfires that have burned 200 square miles and dozens of homes. The improved conditions led to residents clamoring to be let back in to check their properties and assess the damage, but authorities kept evacuation orders in place for hundreds of people.

- A wildfire in the Bridger-Teton National Forest has grown from about 12,000 acres to 23,000 acres, or nearly 36 square miles, officials said.

- In northern Colorado, about 1,900 people were allowed back into their homes on Thursday more than two weeks after the devastating High Park Fire erupted. The blaze was 75 percent contained. The fire killed one woman and destroyed 257 homes, then a state record that was be eclipsed by the Colorado Springs fire.

- A wildfire gaining steam in western Colorado prompted officials to evacuate homes of about 50 residents in the southern part of De Beque as the 15-square-mile blaze threatened to cross Interstate 70 Thursday night. A 13-mile stretch of the highway was closed.

$500,000 award honors pioneering research by scientist at the Children's Hospital of Philadelphia

Douglas C. Wallace, Ph.D., director of the Center for Mitochondrial and Epigenomic Medicine at The Children's Hospital of Philadelphia, will receive the 2012 Genetics Prize of The Gruber Foundation. This prestigious international awarda $500,000 prizerecognizes Wallace's pioneering scientific investigations of the wide-ranging role of mitochondria in the development of disease and as markers of human evolution. Mitochondria are the tiny power plants within the cytoplasm of animal and plant cells.

Wallace will receive the award on November 9 at the annual meeting of the American Society of Human Genetics in San Francisco. The Gruber Foundation, now based at Yale University, announced the Genetics Prize on June 28. The Foundation's Genetics Prize annually honors leading scientists for groundbreaking contributions to genetics research.

Philip R. Johnson, MD, chief scientific officer at The Children's Hospital of Philadelphia, acknowledged Wallace's achievements, saying, "The Children's Hospital of Philadelphia Research Institute is privileged to number Douglas Wallace among our research leaders. His commitment to the field of mitochondrial genetics and his pioneering nature embody the mission of research at CHOP, and his research and leadership are shaping the way we approach therapies for genetic disorders previously considered beyond treatment."

"Douglas Wallace's contributions to our understanding of mitochondrial genetics have changed the way human and medical geneticists think about the role of mitochondria in human health and disease," said Dr. Elizabeth Blackburn, chair of the Selection Advisory Board to the Prize. Blackburn, who shared the 2009 Nobel Prize in Physiology or Medicine, also received the Gruber Genetics Prize in 2006.

Wallace, who came to The Children's Hospital of Philadelphia in 2010 to launch the Center for Mitochondrial and Epigenomic Medicine, first achieved prominence in the 1970s as the leader of a research team at Stanford University that defined the genetics of mitochondrial DNA. This DNA resides within each mitochondrion, as distinct from the more familiar nuclear DNA inside chromosomes. His group showed that human mitochondrial DNA is inherited exclusively from the mother.

This discovery, coupled with other findings, allowed the researchers to reconstruct ancient human migration patterns over hundreds of millennia, a major contribution that bridges genetics and anthropology. Wallace and colleagues also have linked mutations in mitochondrial DNA to a broad range of human diseases, including types of blindness, deafness, metabolic disorders such as diabetes, neuropsychiatric conditions, and age-related diseases such as heart disease and cancer.

The Center for Mitochondrial and Epigenomic Medicine at Children's Hospital researches mitochondrial dysfunction in many clinical problems, and also focuses on preclinical studies relevant to developing therapies for mitochondrial diseases, for which few effective clinical treatments currently exist.

Wallace holds the Michael and Charles Barnett Endowed Chair in Pediatric Mitochondrial Medicine at Children's Hospital and also is a professor of Pathology and Laboratory Medicine in the Perelman School of Medicine at the University of Pennsylvania. He is a member of the National Academy of Sciences, the nation's premier organization of leading researchers, as well as the Academy's Institute of Medicine, and is also a member of the American Academy of Arts and Sciences.

Photosynthesis re-wired

Thursday, June 28, 2012

Harnessing the power of the sun has inspired scientists and engineers to look for ways to turn sunlight into clean energy to heat houses, fuel factories and power devices. While a majority of this research focuses on energy production, some researchers are looking at the potential uses of these novel solar technologies in other areas.

Boston College Assistant Professor of Chemistry Dunwei Wang's work with silicon nanowires and his related construct, Nanonets, has shown these stable, tiny wire-like structures can be used in processes ranging from energy collection to hydrogen-generating water-splitting.

Teaming up with fellow Boston College Assistant Professor of Chemistry Kian L. Tan, the researchers have taken aim at a role for nanowires in photosynthesis.

Their work has produced a process that closely resembles photosynthesis, employing silicon nanowires to collect light energy to power reactions capable of synthesizing the basic compounds of two popular pain-killing, anti-inflammatory drugs, they report in the current edition of Angewandte Chemie, the journal of the German Chemical Society.

The reaction sequence offers an approach that differs from earlier attempts to sequester carbon dioxide with sunlight and solves the vexing problem of carbon's low selectivity, which so far has limited earlier methods to the production of fuels. Tan and Wang report their process offers the selectivity required to produce complex organic intermediaries capable of developing pharmaceuticals and high-value chemicals.

The process succeeds in taming stubborn carbon, which structurally resists most efforts to harness it for a single chemical product. Typically, refined forms of carbon molecules must first be produced to produce the necessary results.

"If we can start to use carbon dioxide and light to power reactions in organic chemistry, there's a huge benefit to that. It allows you to bypass the middle man of fossil fuels by using light to drive the chemical reaction," said Tan. "The key is the interaction of two fields ? materials and synthetic chemistry. Separately, these fields may not have accomplished this on their own. But together, we combined our knowledge to make it work."

During photosynthesis, plants capture sunlight and use this solar energy and carbon dioxide to fuel chemical reactions.

Tan and Wang used silicon nanowires as a photocathode, exploiting the wire's efficient means of converting solar energy to electrical energy. Electrons released from the atoms in the nanowires are then transferred to organic molecules to trigger chemical reactions.

In this case, the researchers used aromatic ketones, which when struck by electrons become active and attack and bind carbon dioxide. Further steps produced an acid that allowed the team to create the precursors to ibuprofen and naproxen with high selectivity and high yield, the team reports.

Tan and Wang were joined in the research by Research Assistant Guangbi Yuan, PhD '12, graduate student Rui Liu, doctoral student Candice L. Joe, and former doctoral student Thomas E. Lightburn, PhD '11.

Tan said it is no accident that the process so closely resembles natural photosynthesis, as chemists are constantly drawing inspiration from nature in their work.

"Researchers in my field are always drawing inspiration from nature," said Tan. "You take the basic lessons and you try to do it in an artificial way. In this work, we're trying to learn lessons from nature, although we can't copy nature directly."

Lawmakers reach tentative deal on highway bill

WASHINGTON (AP) ? Congressional leaders have tentatively agreed on a two-year bill to overhaul federal highway programs that drops a requirement that the government approve the Keystone XL oil pipeline.

Senate aides said they were working Wednesday to put the agreement into legislative language, which must happen before House and Senate leaders formally sign off on the deal. The leaders will also want time to sound out their members' support for the measure. The aides described the deal on condition of anonymity because the deal wasn't final.

House Republicans had pushed for inclusion of a provision that would go around President Barack Obama by requiring a federal energy agency approve the oil pipeline, which would transport oil from Canada's tar sands to Port Arthur, Texas. The White House threatened to veto the bill if Keystone were included.

Also eliminated from the bill was another provision sought by House Republicans that would have blocked the Environmental Protection Agency from regulating the toxic ash generated by coal-fired power plants. The ash is used as an ingredient in some types of cement. Sen. James Inhofe, R-Okla., a key negotiator on the bill, told reporters that both the Keystone and coal ash provisions had been dropped.

House Republicans won concessions from the Senate on environmental reviews of highway projects and on a program that funds bike paths, pedestrian safety projects, beautification and other "transportation enhancements," Senate aides and environmentalists said.

The law requires that the government study potential environmental impacts before starting highway construction projects, but that can cause delays and drive up costs. The deal struck Wednesday would reduce the average time it takes to complete a highway project from 15 years to about eight years.

The agreement also makes other kinds of transportation programs eligible for the same pool of money that funds transportation enhancements, which means there will probably be less money to go around for biking and pedestrian projects.

Republicans have criticized the enhancements program as wasteful, saying it pays cities to plant flowers. Highway landscaping has been an eligible category for funds under the program, but supporters say far more money has gone to biking and walking projects.

Under the agreement, the highway bill would be combined with another bill to prevent a doubling of student loan interest rates. That's because lawmakers plan to use pension law changes to help pay for both measures. Congress is also facing weekend deadlines for both bills: Highway programs and the government's power to levy federal gasoline and diesel taxes are due to expire on Saturday. Interest rates on subsidized Stafford loans would double from their current 3.4 percent for 7.4 million students expected to receive such loans in the year beginning July 1 unless Congress acts.

Both parties see the transportation bill as a jobs creator, and Congress' best bet to do something about the nation's stubbornly high unemployment rate before the November election.

It remained unclear exactly how much the bill would spend. A transportation bill passed by the Senate earlier this year would have spent $109 billion through the end of fiscal 2013. The Republican-controlled House was unable to pass its own comprehensive bill because of divisions within GOP ranks. Instead, it passed a three-month extension of current programs that also included the Keystone and coal ash provisions.

The number of jobs created by the highway bill depends on its spending level. Sen. Barbara Boxer, D-Calif., the Senate bill's sponsor, has estimated that the Senate's original bill would have saved or created 2.8 million jobs.

Anti-Bullying Caucus Launching In Congress

For Rep. Mike Honda (D-Calif.), creating an Anti-Bullying Caucus in Congress was more personal than political.

"As a Japanese American born at the height of World War II, I was placed in an internment camp before I could walk or talk," Honda wrote in a statement.

"For many years after the war, I endured confrontations and insults from my peers solely because of my appearance."

Honda will launch the bipartisan Anti-Bullying Caucus on Thursday, in an attempt to "stop bullying -- both offline and online," according to a release from his office. At least 42 other representatives -- including three House Republicans -- have joined the effort to empower bullied "youth, seniors, religious communities and LGBT-identifying individuals," among others.

Bullying affected Honda's concentration in school, according to Jack d'Annibale, Honda's communications director.

"He struggled as a student," he told The Huffington Post. "It was difficult to be that fearful, and difficult to find his place in the community and the country because of it."

As a science teacher and an elementary school principal and administrator, Honda dealt with "both the bullied and the bullies themselves," said d'Annibale. "He's been on the front lines of this issue for 30 years."

Honda, who represents a large portion of Silicon Valley, including Cupertino, made sure the caucus mission statement specifically addressed cyberbullying, since online attacks are a "fierce and urgent component of the issue as a whole," d'Annibale said. The focus on cyberbullying earned the caucus the support of social media giant Facebook.

In fact, more than 30 groups, including Change.org, the Human Rights Council and the AARP, have pledged to support the caucus. The Department of Education also teamed up with the caucus to address the issue.

This is not Honda's first move to quell bullying around the country. In March, he petitioned the Motion Picture Association of America to reduce its rating of the documentary "Bully" from 'R' to 'PG-13' in an effort to allow younger audiences to see the film. That film will be screened at the Department of Education Thursday evening.

The anti-bullying movement has garnered national attention this year, and President Barack Obama has endorsed two anti-bullying bills, the Student Non-Discrimination Act and the Safe Schools Improvement Act.

Honda and his Democratic colleagues are joined on the caucus by Republican Reps. Charles Bass (N.H.), Robert Dold (Ill.) and Frank LoBiondo (N.J.).

Supreme Court health care ruling watched by ... - Health and Fitness

Depending on what the high court decides regarding the legality of the Patient Protection and Affordable Care Act, the fate of the nation?s health care system is in balance, potentially upending again how the key players are paid.

The statute, often called Obamacare, passed in 2009 and stands to change the industry, so the decision is critical to investors in health care stocks. ?It?s a sweeping piece of legislation that has a broad impact on how (health care) industries are structured,? says Matthew Coffina, health care analyst at Morningstar.

Investors are anticipating how stocks in various areas will react:

?Managed care companies and insurers. If there?s a part of the medical industry facing the most flux from the rule, it?s insurers, says Dave Shove, analyst at BMO. Insurers, such as UnitedHealthcare, WellPoint and Aetna, stand to benefit as more than 30 million additional Americans become potential customers. ?It?s one of the biggest growth drivers the industry will ever have,? says Jeffrey Loo, analyst at SP Capital IQ. But with that comes the increase in government rules over the size of insurers? profits, Shove says.

?Hospital operators. Hospitals are big winners from the statute, thus the largest potential losers if it?s struck down, Coffina says. Under the measure, hospitals get paid for visits by uninsured patients, rather than eating these ?charity care? cases, he says. Large hospitals include HCA and Universal Health Services.

?Medical technology companies. Companies that make medical equipment are among those helped least by the measure, Loo says. These companies must pay a 2.3% annual fee on U.S. sales as a tax part of the rule, Loo says. Big players include Johnson Johnson and Stryker.

?Drug companies. If health care reform stands, drug companies benefit, because it takes many more onerous rules off the table, Loo says. If the measure is overturned, drug companies may need to brace for discussion to reopen on tougher rules , he says.

Since most health care companies benefit from the rule, the biggest risk is the measure being overturned, Loo says. If the measure is rejected, investors must brace for uncertainty as lawmakers go back to the drawing board, Shove says. ?What is judicial risk will turn into election risk and then legislative risk,? he says.

{Songfic 23-30 June} Vnnecessarie Payne: A Faulte of Wil

O Heauen! O sorrow droppe from mine brest,
Ne'er hath been svch a sovl of maiden faire,
Thieved of her covntenance; nights of un-rest,
Ador'd curve of shoulder and coif of hair.
Dark paines of loue; no waxing inundation of sunne,
How doth saints talk of goodnesse where there is none?
What sorowe full desyn; a pouertye of swete yet richesse soure,
Swallowed in an Abyssian cloake; a lyfe of miserrie in but an houre,
Absent her; a bodie lacking heade, a window absent glasse,
Vnlike ships; transitory as their wont mine griefe shall not passe.

Ophelia, A Certaine Iewel
Iohann Nashe, 1582

"Well?"

Thomas Spencer looked up from the parchment and rubbed his eyes. It would be easily digested by the cretins that lived for such pitiful stuff. To Spencer it was a farce; a fool's jest complete with piebald cap. "I pray you did not spend your entire purse on such brilliant calligraphy?"
John frowned."Calligraphy? That is what stirred you when heartsblood is as plain in that composition as heat from fire?" John Nashe drank the remainder of his beer. "It's flowing with-"

"Pompous twaddle." Thomas Spencer interjected, rolling his eyes. Nashe scoffed. "Oblige me to read it aloud and then you shall see." Thomas listened, his eyes looking up in vexation or as this was a first tried dish and he was unsure of the flavour. When John finished the other man sighed. "It's floral John, sugary adolescence but now you need to write more like John Heathgrave than John Nashe. Less verbose homily more crudely described fornication." Thomas said in all jocularity. John winced. Never had his works been compared to the offensive scrawlings of that Scotsman. Gone are the pastoral settings replaced with crowded streets of toothless peasants slinging defecate where their shoeless bastards beg for coins. Perhaps all culture will soon be judged by the merits of the Heathgraves of the world. "I say John, my boy you were a thousand leagues away. I understand your story, many a life has been taken for lost love but in truth you saw this beauty last when?"

"She was fifteen," John begrudgingly admitted. "I was seventeen."

"There you have it, you are twenty four! Some romanticised riverside fumblings with a lass just encroaching upon womanly budding and you write of sorrow? Something truly of immeasurable grief would have to happen for you to be a noted Tragedian. Indecently, where did this dove fly so you cannot follow?" John sighed. "Wurzburg, working the kitchen of a nobleman. I wrote her three years ago letting my intentions be known. She did not respond." He finished his beer and ordered another.

He smiled at John as the fresh beers were poured. "A broken heart is a malady easily cured sans a visit to an apothecary. John, buy a woman and lay with her. Or find something worth lamenting and make us both rich."

"Thomas, were you a gentleman I'd demand this be settled by the sword." John said. "Wonderful luck that, me being common." Thomas replied.
The men shared a laugh but once again John grew distant. "I've simply lost my taste of this place; I find no joy in drink or when I sup. I feel as though this world is passing me by, I stumble through this grey fog, wasting time. I'm waiting Tom; I'm waiting to find a light, something to illuminate a road I know not." Spencer nodded. It was common to experience a pall when one reached middle age. "I'm thirty one John. I walked the very halls of uncertainty that vexes you now, but it passes like a consumed harvest feast."

"You are poignantly uncouth."

"A trait some find endearing, you need not walk the halls alone. I will publish your poem in a collection later this month because I find it distasteful to see such an aged man in morose exposition." The John smiled. "Yet I still wish to do something daring; mayhap obtain a commission and marry Ophelia? I'm going to go to the ships now and might be gone by the morning. You may write of my adventures." He chuckled."Or write your eulogy." Tom frowned."Such a glower, you?ll see. I will make her proud to have me." With that comment he stood and left the tavern. Thomas could have retrieved him, but he wanted John to find what he was seeking nevertheless sleep came difficultly that night.

***

The tavern was filled with patrons due to the recently berthed ships. The atmosphere was a cacophony of foreign songs and vulgarity. It caused Thomas an internal distemper and he would rather take his leave from the horde. As he stepped out the door into the early afternoon air a young woman bumped into him. "Is this The Pembrooke tavern?"

"It is but it's somewhat over populated now, best come back early evening." He said.

"I'm looking for a boarder here."

"I stay here, one Thomas Spencer is it I you seek? This would make a disagreeable day rather brighter." He smiled. The woman returned the smile.
"A man named John Nashe."

"The lost Ophelia."

"You know of me?" She asked."By reputation, John did mention you yet I'm afraid he left for sea in an effort to quiet his thoughts regarding you.
"But I wrote him every month he never responded, did he get my letters?"

Of course not you soft-headed sow. I burned them all. "I cannot say, perhaps your words spurred him to the action he decided. There may still be a chance to catch him. Wait here in case he may return."

Thomas made haste until he rounded the corner of the tavern; one could see the harbour from the Pembrooke it was but a five minute brisk walk but he would take his time this day. He strolled past the alley that always smelled like piss, acknowledged the vendors; their button eyes and gypsy sneers adding to the unsavoury air of commerce. "Pork Pie today Tom?"

"Ah, but you see I?ve already had diarrhoea this morn." He whistled a jaunty tune and saw John right away; the man wore an indigo doublet complete with ruff. "You look like a valet. How goes your naval charge?"

"It has been an experience. My ship is a claimed French frigate, crewed by Turks and Poles. Only I the captain and one rigger are English. Did you see the name Tom?" The other man read it and clicked his tongue "Phillip's Decumbence." He looked at John and frowned. "A tad incendiary for the moniker of her majesty's vessel, you're a pirate then. Your father would be proud." Tom sighed, growing more proud by the moment. "Supposition is the tools of a simple mind; we are a sealed privateer with direct orders to sink anything flying Spanish colours." John beamed. "A gentleman stands before me; perhaps it's enough to win your lady fair? At any rate, I am proud of you. I've enjoyed our time together."

"And me, Tom. Take care of yourself. I will write." The men nodded at each other and parted ways.

Walking in the Pembrooke Tom glared where Ophelia sat, out of place like a stone in a field. "Dear girl, he left but this morning. They said his ship along with three others is to hunt Spanish standards. A dangerous mission, some say a mortal mission they don't expect any of them to return. He left almost as soon as you arrived; likely you passed each other on dock would be my guess. Regrettable you did not arrive sooner."

The woman began to cry, daubing at her eyes with her apron.

"There is a place behind Sommersette Inn atop the hill where other women with longing in their hearts frequent to stare at the sea to find a quiet. Some swoon and meet tragic ends due to loose rocks and unsure footing. I don't believe in self-murder but it really wouldn't be if one ponders it, due to the rocks you see." He gave her arm a knowing squeeze. She nodded and stood to leave; already beginning to pine and yearn for an escape.

"Good-bye Ophelia." He said watching her walk away to what will most likely be her death. He ordered wine and felt invigorated; it was not everyday one could orchestrate such a profitable misfortune.

Branding ? What You Need to Know to Protect Your Brand Legally ...

By Sarah J. (Miller) Schneider, Attorney and CWCC Member

It feels like a personal affront to receive a cease and desist letter just when your business is starting to turn heads.? A cease and desist letter is a demand from a third party to stop using the name of your business because, well, it belongs to someone else.? Should you have done something differently?? Could this have been avoided?

Your trademark is the brand identity of your company ? it represents the source and quality of the products and services you provide under the mark.? Many new businesses start marketing their brand only to find out that, after spending money on advertising, product placement and packaging, their new business or product name infringes upon the trademark rights of another party.? It is because your trademark is so important that you should stop, slow down and consider the legal side of branding before introducing a new mark to your customers.

First, come up with several name ideas and be prepared for a few of them to be taken.? If you can invest some legal dollars, hiring a trademark attorney to assist you in evaluating the risks associated with adopting your new mark is best.? However, even if you don?t work with a trademark attorney, do some initial investigation first.? Conduct searches for your proposed trademark on the Internet with various spellings.? Look at directory and business listings and search for the proposed mark in the U.S. Patent and Trademark Office database.? Do not rely on the fact that the Secretary of State?s Office lets you form your business in their database as an indication that the mark is available for you to use.

A trademark need not be identical or used on the same type of goods or services to be considered infringing.? The legal test for trademark infringement is if a consumer likely would be confused by the source of the product or service.? The most important elements of the infringement test are the similarity of the marks and the similarity of the products or services.? If you find someone else is already using your proposed mark for unrelated goods or services, you may be able to use the mark.? Take DELTA airlines and DELTA faucets for example.? Although they use the same mark, consumers do not believe the DELTA faucets are made by DELTA airlines.? Famous brands that are more unique, however, have a much further reach with respect to unrelated goods.? You could not, for example, start using COKE for tennis shoes, despite the differences in the goods.

Legally, the strongest trademarks are those that are fanciful, made up-words, think GOOGLE and XEROX, or commonly known words used arbitrarily, think APPLE and AMAZON .? You can also combine different parts of words and create a new word, like ZIPLOC.? Get a dictionary and a thesaurus, combine word parts and sounds together, consider unique words and be creative.? Do many other businesses already use the name?? If so, you are more likely to receive a cease and desist letter, and less likely to stand out in the marketplace.

Selecting and choosing a mark is not black and white, and there are many different things to consider in launching your brand, but determining the legal availability should be at the top of the list.

Sarah Schneider is a trademark attorney with the intellectual property law firm of Sheridan Ross P.C. in Denver.? She works with companies of all sizes and types to secure, protect and defend their trademarks and service marks.? From bio-refining services to handbags, every product or service originates from somewhere, and Sarah helps ensure that consumers know for whom a brand speaks.? From the first trademark application to applications around the world, Sarah finds it particularly rewarding to watch a client?s business and brand recognition develop and grow.? She enjoys working with clients in a collaborative and educational manner and especially enjoys assisting clients with the legal aspects regarding use of brands in the interactive on-line environment.

Remapping gang turf: Math model shows crimes cluster on borders between rivals

Monday, June 25, 2012

A mathematical model that has been used for more than 80 years to determine the hunting range of animals in the wild holds promise for mapping the territories of street gangs, a UCLA-led team of social scientists reports in a new study.

"The way gangs break up their neighborhoods into unique territories is a lot like the way lions or honey bees break up space," said lead author P. Jeffrey Brantingham, a professor of anthropology at UCLA.

Further, the research demonstrates that the most dangerous place to be in a neighborhood packed with gangs is not deep within the territory of a specific gang, as one might suppose, but on the border between two rival gangs. In fact, the highest concentration of conflict occurs within less than two blocks of gang boundaries, the researchers discovered.

The findings appear online today in Criminology, a peer-reviewed scholarly journal published by the American Society of Criminology, the world's largest society of scholars conducting research on crime.

"Maps of gang territories provide police with a better understanding of how to allocate resources," said research co-author George E. Tita, an associate professor of criminology, law and society at UC Irvine. "So figuring out the most accurate approach is really important for effectively deploying law enforcement."

Currently, law enforcement agencies map gang territories based on police observation of such clues as graffiti and where gang members hang out. In these maps, geographic features like streets, parks and schoolyards typically delineate gang territories.

For the Criminology study, the team used Lotka?Volterra equations, which were designed to model the population dynamics of species competing for common resources. Since the 1930s, ecologists have used the equations to study the relationships between competing groups as diverse as bee colonies, troops of chimpanzees and prides of lions.

The equations are based on the principle that competition between groups determines where the boundaries between rivals form, and even a tiny amount of competition is enough to cause territories to form.

"What's at work is a competitive balancing act where both gangs are trying to keep their rival as far away as possible," Brantingham said.

The model the researchers derived from the equation predicted that gang boundaries would form midway between the home bases of rivals and would run in a perpendicular line between them.

The team looked at 13 gangs in the 6.5-square-mile area of Boyle Heights, a densely populated neighborhood on Los Angeles' east side that is bounded by three freeways. Gang activity tends to be confined within the freeway-bounded area.

To determine the home bases for each gang, the researchers relied on a prior study by Tita and his UC Irvine colleagues. The locations of the home bases ranged from a specific street corner to someone's house, a neighborhood business or any other specific location where a gang gathers most frequently.

Using the Lotka?Volterra formula, Brantingham's team drew boundaries between the known gangs. Unlike law enforcement's maps, the resulting effort did not produce gang boundaries that neatly followed streets. Instead, the boundaries ran through the yards of homes and businesses and through alleyways. When the boundaries did land on streets, they were as likely to crisscross them as follow them.

Using police records, the researchers then mapped 563 known gang crimes that occurred between 1999 and 2002 and have been attributed by police to at least one of the 13 gangs. To their surprise, most of the crimes fell on the borders that the model laid between gang territories. When crime locations did deviate from the borders, they did so in a configuration that was consistent with the model. For instance, the theory predicted that 58.8 percent of the crimes would occur within one-fifth of a mile of the border between two gangs ? or just under two blocks ? and 87.5 percent within two-fifths of a mile of the border ? or just over three blocks. Overall, 99.8 percent of crimes could be expected to occur within one mile of the border, according to the theory.

In fact, the team found that 58.2 percent occurred within two blocks of the border and 83.1 percent within just over three blocks of the border; in total, 97.7 percent of the crimes took place within one mile of the border between gangs.

"You would think that we're more complicated than other animals, so a model this simplistic shouldn't work, but I was surprised that it fit as well as it did," said co-author Martin B. Short, an assistant adjunct professor of mathematics at UCLA.

It's no coincidence that Lotka?Volterra equations would have bearing on the configurations of gang territories: The same forces that define territories in the animal kingdom also are at work in all kinds of rivalries between groups of people, the researchers stress.

"The findings match up with what we know about any conflict," Tita said. "Skirmishes tend to occur on disputed boundaries on which individuals, organizations or nation-states seek control."

The researchers plan to compare their gang maps with those derived by law enforcement.

E.O Wilson and Sylvia Earle see the through very different lenses. Wilson started with his eyes to the ground, following ants as they lead him to the study of biodiversity and human nature. Earle dove into the Gulf of Mexico to focus on aquatic plants. That underwater view ultimately led her to study the relationship between degrading seas and life everywhere.

HBT: Youkilis trade may not be imminent

It?s well past noon and we haven?t checked in on the Kevin Youkilis rumor mill. Time to rectify that.

CSNNE.com?s Sean McAdam has the goods:

Five teams ? the Los Angeles Dodgers, Chicago White Sox, Cleveland Indians, Atlanta Braves and a fifth unidentified team ? are evolving.

The Pittsburgh Pirates and Arizona Diamondbacks, a second source revealed, while once involved in talks for the infielder, are no longer part of the mix.

FOX Sports? Ken Rosenthal tweeted?late Saturday night that the Dodgers were only engaging in ?minimal contact? with the Boston front office. He also called the Indians a ?longshot.? So we might be able to go ahead and rule out those two teams as well.

Youkilis is in the Red Sox starting lineup on Sunday against the Braves, batting sixth and playing third base. Will Middlebrooks ? the sudden star who has rendered Youk expendable ? is serving as Boston?s DH.

Kevin Richardson Vampire Movie: From Backstreet Boy To Bloodsucker

Kevin Richardson may have recently reunited with the Backstreet Boys, but it looks like the fifth member of the '90s boy band kept himself busy during his six-year hiatus from the group.

The 40-year-old actor/singer/dancer/model has a new film coming out, and let's just say that he's going to give Edward Cullen and Eric Northman a run for their money. Richardson is sinking his teeth into vampire fandom, playing a drug-addicted bloodsucker in "Bloody Indulgent," a sexy -- and violent -- movie musical. Yes, BSB fangirls, that means not only will Richardson's vampire be sucking blood and snorting cocaine, but he'll also sing a lovely little tune while doing so.

In a recent interview with E! Online, Richardson said that his character has a lot of "different issues he's trying to work through," but when it came to actually playing a vampire, he'd seen enough of "True Blood" to know what he needed to do. However, there's one vampire franchise that Richardson is not so keen with. "I haven't seen seen any of the 'Twilight' movies," he said.

This isn't the Backstreet Boy-turned-actor's first encounter with mature material. In "The Casserole Club," he had a few raunchy sex scenes. "This was actually the first time I've done any onscreen love scenes or anything like that," he told E! Online. "So yeah, it was awkward."

But don't worry BSB fans. Richardson isn't giving up the band (again) for the silver screen. The Backstreet Boys are back -- alright! -- and are currently planning a 2013 album release and world tour, just in time for their 20th anniversary.

In other boy band news, 98 Degrees is officially reuniting for just one night (una noche). 98 Degrees -- Nick Lachey, his brother Drew Lachey, Jeff Timmons and Justin Jeffre -- will come together for the first time in ten years for one performance at the Summer Mixtape Festival in Hershey, PA.

However, 98 Degrees isn't the only '90s pop group set to reunite in 2012. In March, S Club 7 announced their plans for a small UK tour and two new albums. Meanwhile, the Backstreet Boys, who recently toured with New Kids on the Block, are also planning to release a new album in 2012. Also, television executives are considering making a 90-minute Spice Girls documentary timed with the group's new musical Viva Forever!, reports The Mirror.

Want to know if your favorite pop act is reuniting in 2012? Check out the slideshow below.

  • S Club 7

S Club 7 -- a British pop group created by former Spice Girls manager Simon Fuller and consisting of members Tina Barrett, Paul Cattermole, Jon Lee, Bradley McIntosh, Jo O'Meara, Hannah Spearritt and Rachel Stevens -- rose to international fame in 2000, before splitting in 2003. In March 2012, it was announced that all original seven members would reunite for seven UK shows, with possibility of a two-album record deal.

  • The Backstreet Boys

Unlike almost all of the other 90s boy bands, the Backstreet Boys never really broke up -- although original member Kevin Richardson did quit in 2006. In 2011, the Backstreet Boys toured with New Kids on the Block, and BSB is planning to release a new album in 2012.

  • Spice Girls

After reuniting in 2007 for a Spice Girls reunion tour, the British girl power group may reunite again for Queen Elizabeth's upcoming Diamond Jubilee in June. Scary, Baby, Sporty, Ginger and Posh may also don their platform boots for the London 2012 Olympic Games this summer.

  • New Kids On The Block

After reuniting in 2008, New Kids On The Block embarked on a highly successful reunion tour. Then in 2011, they joined The Backstreet Boys for the NKOTBSB tour and released a compilation album of the same name, featuring their hits "You Got It (The Right Stuff)" and "Hangin' Tough," and a new recording, "Don't Turn Out the Lights."

  • Take That

Take That formed in 1990 and after a few No. 1 UK singles, the British boy band split in 1996. However, the group reunited in 2005 and have been touring and releasing new music ever since. The band's next album is expected to hit shelves in late 2012, and Take That is also in talks to open the London 2012 Olympic Games.
